Areas of Practice

Parker Bagley is a partner in the firm’s Litigation Department and a member of its IP Litigation Practice. He specializes in trademark, patent, copyright, trade secret, false advertising and Internet domain name litigation, and client counseling. Mr. Bagley joined Goodwin Procter in 2008.

Work for Clients

Mr. Bagley has represented the successful litigants in IP cases involving trademark infringement, patent infringement, copyright infringement, trade dress infringement, false advertising and trade secret theft and defamation. He has represented litigants in numerous jury and bench trials, including:

  • Star Industries v. Anheuser Busch - successful defense of Anheuser Busch against trademark infringement claims.
  • Physician’s Formula v. Dermablend - jury verdict of intentional trademark infringement in favor of L’Oreal subsidiary Dermablend.
  • Baldwin Hardware Corp. v. Franksu Enterprise - patent infringement found after bench trial for client Baldwin.
  • Banff Ltd. v. The Limited Inc. and Express Co. - jury verdict of copyright infringement for client Banff.
  • Masco Co. v. Price Pfister, Inc. - jury verdict of patent infringement for client Masco (Delta Faucet).
  • Reebok Intl. v. Kmart Corp. & Melville Corp. - trade dress infringement dismissed after bench trial for client Melville.
  • McDonald’s Corp. v. Druck & Gerner D.D.S. - trademark infringement in favor of McDonald’s found after bench trial.
  • Celebrity Service Intl. v. Celebrity Intl. World, Inc. - willful trade secret theft, defamation and trademark infringement found after bench trial for client Celebrity Service; punitive damages and attorneys fees awarded.

Mr. Bagley has also successfully argued dozens of preliminary injunctions and TROs for clients including MetLife, L’Oreal, Paine Webber, MasterCard and the International Securities Exchange and won summary judgment of non-infringement for Tyco Medical in a patent case involving medical electrodes and for Digene Corp. on antitrust counterclaims in a patent case involving HPV tests. less »

Professional Activities

Mr. Bagley is an active member of INTA and AIPLA. He was named one of the top four trademark litigators in the United States in a 1999 Managing Intellectual Property survey of IP practitioners. Mr. Bagley was also named to Euromoney’s “World’s Leading Trademark Law Practitioners” in 1997 through 2007 and to the International Who’s Who of Business Lawyers in 2002 through 2007.

Mr. Bagley served as the Chair of AIPLA’s Trademark Legislation Committee for 2004-2005. He is on the editorial advisory board of Fordham Intellectual Property, Media and Entertainment Law Journal, and has taught at Fordham Law School.

Publications/Presentations

Mr. Bagley frequently speaks on various topics at INTA and AIPLA meetings and forums. He authors the regular “Patent and Trademark Law” column in the New York Law Journal, and has written articles for numerous other publications. Mr. Bagley has been interviewed on intellectual property issues by a number of publications, including The New York Times, Corporate Legal Times, American Banker, The New York Observer, Entrepreneur Magazine and the New York Law Journal.

Prior to joining Goodwin Procter, Mr. Bagley was a partner in the Intellectual Property Group of Milbank, Tweed, Hadley & McCloy LLP.
